Fair Usage Policy for 3CX AI Service

1. Introduction

This Fair Usage Policy ("FUP") outlines the acceptable use of 3CX AI Service, provided by 3CX. The policy ensures fair access for all users while preventing abuse that could degrade service quality or violate laws. By using 3CX AI Service, you agree to comply with this FUP.

This FUP forms part of the contractual framework governing use of the 3CX AI Service and applies in addition to the applicable License Agreement, Subscription Terms, Data Processing Addendum (DPA), and Privacy Notices. In the event of conflict, the stricter provision shall prevail.

The 3CX AI Service is not intended for use in high-risk environments (e.g., emergency services, life-critical systems, or safety-critical operations), and no representations are made regarding its suitability for such purposes.

2. Definitions

  • User: Any individual or entity accessing 3CX AI Service.
  • Transcription Request: A single audio file or stream submitted for processing.
  • Analysis Request: A request to analyze transcribed content or other data processed by 3CX AI Service.
  • Account: A registered user account tied to billing and usage tracking.
  • Prohibited Content: Material that violates this FUP (detailed in Section 3).
  • AI Output: any text, summary, transcript, sentiment analysis, or other machine-generated content produced by the 3CX AI Service. 3CX does not guarantee accuracy, completeness, reliability, or fitness-for-purpose of AI Output.
  • Automated Activity: includes bots, scripts, or programmatic attempts to access, query, or submit data to the 3CX AI Service outside normal user behavior.
  • Service Abuse: includes any use reasonably expected to impair service integrity, degrade performance, cause excessive load, or circumvent usage controls.

3. Prohibited Uses

The following are strictly prohibited:

Uploading or processing content that:

  • Involves child exploitation or non-consensual intimate content.
  • Automated scraping, spamming, or high-volume requests designed to overload 3CX AI Service.
  • Reverse engineering, decompiling, or attempting to extract proprietary model details.
  • Reselling or redistributing processed outputs without authorization.
  • Any other activities or content that 3CX, at its sole discretion, determines to be inappropriate or harmful to the service or its users.
  • Submitting content that violates applicable law, including copyright, trade secrets, privacy rights, GDPR, ePrivacy rules, or telecommunications laws.
  • Uploading recordings obtained without required consent under local law or workplace monitoring regulations.
  • Using the 3CX AI Service to process sensitive categories of personal data (e.g., health data, biometric data, political opinions) unless explicitly permitted under a signed agreement and configured accordingly.
  • Attempting to manipulate model behavior, exploit vulnerabilities, circumvent safety constraints, or generate harmful outputs.
  • Using the service for benchmarking, model comparison, dataset extraction, or model replication without written permission.
  • Introducing malware, corrupted audio files, adversarial inputs, or any material intended to disrupt AI processing.
  • Using AI Output to mislead, impersonate, defraud, or deceive third parties (including deepfake-like uses).
  • 3CX reserves broad discretion to determine whether any use constitutes prohibited behavior.

4. Usage Limits

To maintain service reliability, 3CX reserves the right to set and enforce usage limits at its sole discretion. These limits may vary based on account type. Excessive use, as determined by 3CX, may result in additional fees, as specified in the Subscription Terms or your Order Form.

Usage limits may include caps on daily or monthly processing time, number of requests, file size, concurrency, rate limits, and bandwidth utilization.

3CX may dynamically adjust limits depending on system load, abuse patterns, compliance requirements, or subscription tier.

Attempts to circumvent limits (e.g., via multiple accounts, automated scripts, proxying traffic, or distributing requests across tenants) constitute a violation of this FUP.

Where applicable, exceeding usage limits may result in:

  • throttling or rate-limiting
  • temporary queueing delays
  • additional charges under your subscription
  • temporary account suspension, or
  • automatic disabling of specific features

5. Monitoring and Enforcement

  • 3CX monitors usage patterns to detect violations.
  • Automated systems and manual reviews may flag suspicious activity.
  • Users must provide accurate account information and cooperate with investigations.
  • 3CX reserves the right to take any additional measures it deems necessary, at its sole discretion, to enforce this FUP and protect the service.
  • Monitoring is limited to what is necessary to ensure security, detect abuse, maintain service performance, and comply with applicable laws. 3CX does not monitor the content of communications unless legally required or explicitly instructed by the customer under a DPA-compliant arrangement.
  • 3CX may collect and analyse metadata (e.g., IP addresses, request rates, file sizes, error patterns) to identify misuse, fraud, security incidents, or automated behavior. Such processing will comply with GDPR and other applicable regulations.
  • Failure to cooperate with a security or abuse investigation may result in immediate suspension.
  • 3CX may also implement automated controls such as anomaly detection, model-level abuse detection, and anti-scraping safeguards.

6. Consequences of Violation

Violations may result in:

  • Warnings or temporary account suspension.
  • Permanent termination without refund.
  • Reporting to authorities for illegal activities.
  • Liability for damages caused by misuse.
  • Any other actions 3CX deems appropriate, at its sole discretion, to address violations of this FUP.

Consequences may additionally include:

  • Immediate disabling of AI features or throttling of processing capacity.
  • Restrictions on future access to 3CX cloud services.
  • Additional fees for excessive resource consumption, remediation, or harm caused to infrastructure.
  • Contractual remedies including suspension under applicable licence or subscription terms.
  • Preservation and disclosure of logs to competent authorities where required by law.

3CX may take proportionate action without prior notice where necessary to protect system integrity or comply with urgent legal obligations.

7. Changes to This Policy

3CX may update this FUP at any time without notice. Continued use of 3CX AI Service constitutes acceptance of the updated policy.
