The terms and conditions are provided for your convenience only. We do not make any guarantees and disclaim any liability regarding any of the information provided on the website. We are not obliged to provide any part of the website and we reserve the right to add, change, edit or remove any part of the website, including the terms and conditions, without notice and for any reason whatsoever at our discretion.

These Terms & Conditions apply solely to your use of the 3CX websites. They do not govern the use of any 3CX software, cloud services, PBX systems or licensed products, each of which is subject to a separate agreement, license or policy.

  • attempts to bypass or defeat security mechanisms
  • interference with website functionality

  • impersonation of 3CX staff, partners or customers

We may use any technical means to prevent unsolicited bulk communications from entering, utilising or remaining within our computer or communications networks even if doing so may result in a disabling of your account, whether partially or completely and temporarily or permanently.

For clarity, nothing in these Terms obliges 3CX to monitor user-generated content in real time, to proactively detect unlawful communications, or to undertake continuous surveillance of user activity. 3CX does not monitor, intercept or access the content of communications except where required by law, upon a lawful request by a competent authority, or where necessary to investigate serious misuse, security incidents, or fraud affecting 3CX systems.

You acknowledge that 3CX may implement automated security measures such as IP blocking, rate limiting, fraud detection alerts, and anomaly-based traffic filtering, which may temporarily restrict access where suspicious or abusive behavior is detected. These measures are implemented solely to protect the security and stability of 3CX infrastructure and are not intended for content monitoring.

Cautions and Disclaimers

Assignment

These terms and conditions shall inure and be binding upon the successors and assignee of the parties hereto. You are not allowed to assign or transfer any of your rights or obligations under these terms and conditions. We reserve the right to assign or transfer the website or any information or software contained or referred to therein to any third party without notice and without imposing terms to your benefit.

Any assignment by 3CX may include the transfer of website operations, infrastructure, hosting services, data, or content to affiliated entities, service providers or successors. These Terms govern only the use of the website. They do not modify, override, supersede or replace any:

In the event of conflict between these Terms and any such agreement specifically governing 3CX software or services, the terms of the latter shall prevail.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the parties agree that such provision will be limited or modified only to the minimum extent required to make it enforceable, and the remainder will continue in full force.

Law Enforcement Requests

3CX may cooperate with law-enforcement authorities only to the extent required under applicable law.

Customers acknowledge that:

  • 3CX is not obligated to act on allegations of fraud or misuse unless supported by a valid legal basis;
  • any request from a foreign authority has legal effect only if properly submitted through the competent local authorities in the jurisdiction of the relevant 3CX entity;
  • 3CX may, at its discretion, request clarification, reject informal or unsupported allegations, or take proportionate internal measures without assuming any duty to investigate or report.

Nothing in this Agreement imposes on 3CX any obligation to monitor Customer activity or to report potential criminal conduct unless legally required.

Competent Courts and Applicable Law

Any and all disputes regarding the provision of, use of, access to or participation in the website or any information or software contained or referred to therein shall be submitted to the non-exclusive jurisdiction of the Courts in the jurisdiction of the selling company, at our option and to our benefit. These terms and conditions shall be governed by and interpreted in accordance with the laws of the selling company’s jurisdiction excluding any conflicts of law provisions which would, but for their exclusion, prevent the applicability of the laws of the selling company’s jurisdiction. You agree that hereby you are waiving any claims that you might otherwise have had based on the laws of any other jurisdiction.
